収容・送還専門部会を初めからやり直し、議論の間は被収容者を解放してください!

収容・送還に関する専門部会委員 各位

 入管収容施設での長期・無期限の収容と、その間の不当な扱いの問題が、日に日に明らかになっています。
 法務大臣は、2019年10月に「私的諮問機関 収容・送還に関する専門部会」に解決策を諮問しました。
 ところが、そもそも部会の発足の際に法務省がHPで公表し、部会委員に配布した「送還忌避者の実態について」は、銃刀法違反の有罪判決しか受けていない人を、「警察官殺人未遂事件」と題して、殺人未遂・公務執行妨害・銃刀法違反の有罪判決を受けたかのような、事実と異なる記載をして、被仮放免者の印象を不当に悪くしていたことが衆議院法務委員会の質疑で明らかになりました。「送還忌避者の実態について」は、現時点(2019年12月10日)で法務省HPで閲覧できません。
 しかし、このことが専門部会委員にどのように説明されているのか、同資料が専門部会の資料からも撤回されたのか、発表はありません。
 そもそも、長期・無期限収容とその間の処遇について、法務省入管庁に原因・責任がないかのように、法務省入管庁が作成した資料を出発点にして部会が発足したこと自体、不公正なのです。
 専門部会の議論を初めからやり直し、日弁連や人権団体の資料を最初から部会委員に配布して議論を初めてください。
 そして、未だ議論がされている、何も法令が変わっていない今、仮放免を認めず収容を長期化する方針(注1)を一旦撤回して、長期被収容者を解放してください。この要求は、常識上当然のことと考えます。

Every day that passes is revealing the problems with long-term and unlimited detention at immigration detention facilities, and the unjust treatment of detainees during that time.
In October 2019, the Minister of Justice requested that its "Private Advisory Body: The Expert Committee on Detention and Deportation" find a solution to these issues.
But, as has now become clear during question time for the House of Representatives Legal Affairs Committee, that a document which was made public on the Ministry of Justice's web site at the inception of the expert committee and distributed to committee members—"On the situation of those refusing deportation"—had categorized people merely convicted for violating the Firearms Control Law under "Incidents of attempted murder against a police officer". As if these people had been convicted of attempted murder, obstruction of police duties, and of violating the Firearms Control Law. These descriptions are contrary to reality and unjustly tarnish the image of those on provisional release. At this time (October 12, 2019) "On the situation of those refusing deportation" cannot be viewed from the Ministry of Justice's web site. 
However, there has been no announcement as to how this was explained to members of the expert committee, or as to whether this same material had also been withdrawn from documents provided to the expert committee.
It was unjust from the very start that the committee began its work with documentation produced by the Ministry of Justice's Immigration Agency that made as if the Ministry of Justice was not responsible for the long-term and unlimited detention, and treatment of detainees during that time.
We ask that the expert committee restart its discussions from the beginning and be sure to provide documents from the Japan Federal Bar Association and other human rights organizations to committee members before commencing debate.
Furthermore, as the debate is ongoing and there no changes to the law have been made at this stage, we ask that you temporarily desist from the course currently being taken where provisional release is not being granted and the period of detention prolonged (1). We think that this demand is simply what would be expected based on commonsense.
